Chapter I GENERAL PROVISIONS

Article 1 (Purpose)

These Terms of Use are for the purpose of specifying terms and conditions of use of the Information Service (hereinafter referred to as "Service") provided by VONSQUARE Co., Ltd. (hereinafter referred to as "Company").

Article 2 (Effect and Change of Terms)

  • The Terms shall be effective upon posting on the Service screen or otherwise having been notified to the Member.
  • The Company may change these Terms if there are reasonable grounds for them to be changed. If the Terms are changed, the Company shall announce this at least seven days in advance in the same manner as in Clause 1.

Article 3 (Application of Relevant Rules)

The matters not specified in these Terms are subject to the provisions of Framework Act on Telecommunications, Telecommunications Business Act and other relevant laws and regulations.

Article 4 (Definition of Terms)

Terms are defined as follows

  • Member, Member Company: An individual, corporation, or corporate-like that has entered into a contract with the Company to use the Service.
  • Operator: The person selected by the Company for overall management and smooth operation of the Service.
  • ID: A combination of letters and numbers used to sign up for member identification and member service.
  • Password: A combination of letters and numbers set by the member themselves to protect their confidentiality(or that of member company).
  • Suspension of Service: Discontinuation of the Service for a certain period of time according to the fixed conditions set by the Company during normal use.
  • Termination: A company or member revokes the contract after beginning the Service

Chapter 2 CONTRACT OF USE

Article 5 (Classification of Service)

  • The Company distinguishes between the free Service and the paid Service.
  • The type and contents of the Service are determined by the Company separately from the notice or Service use guide.

Article 6 (Establishment of Use Contract)

  • By clicking on the "Agree" button, the member (or member company) will be deemed to have agreed to the terms and conditions.
  • The use contract is established when the Company approves the application for use by the member (member company). The company will notify the applicant of the use consent within 24 hours of the application date through the e-mail noted at the time of application.

Article 7 (Application for Use and Approval)

  • In order to use the Service, the following items should be recorded on the signing up application form of the Service.
    • Name
    • E-mail
    • ID, Password
    • Address
    • Telephone number
    • Member Level
  • The use contract shall be established with the consent of the Company for the user registration of the member.
  • The Company will refuse to accept the application for the following reasons.
  • In case of Article 9 Clause 3

Article 8 (Change of Use Contract)

If a member changes any of the items listed at the time of application, he / she shall request modification from the operator.

Article 9 (Termination of Use Contract)

  • The use contract shall be immediately terminated by the member or company.
  • If a member withdraws, the company will immediately apply for termination via e-mail.
  • In the following cases, the Company may not accept membership or the membership may be deprived.
    • The member has applied for a sign up using someone else's name.
    • In case of false entry of the required information
    • Applying or carrying out such acts for the purpose of violating related laws and regulations
    • Applying for the purpose of hindering social well-being or morals
    • Threatening the electronic transaction order by interfering with the use of others or stealing the information

Article 10 (Acquisition and Use of Personal Information)

  • The Company enacts and enforces the Privacy Policy and abides by the laws regarding the acquisition, use and protection of personal information. The Privacy Policy is posted at the bottom of the homepage at all times.
  • The Company may not use the personal information provided by the customer for any purpose other than the Service.
  • The Company cannot provide the personal information provided by the customer to a third party without prior consent of the customer. However, the following exceptions are applicable.
    • Based on the request of a national agency in accordance with related laws such as Framework Act on Telecommunications
    • If there is an investigative purpose related to a crime or a request from Korea Communications Standards Commission
    • When using member's information (name, address, telephone number) for business communication
    • If the Company needs to share some information about banking matters
    • It is necessary for statistical writing, promotional materials, academic research or market research, and provided in a form where a specific customer cannot be identified

Chapter 3 SERVICE USE

Article 11 (Use of the Service)

  • The Service will be started immediately when the Company accepts the membership application.
  • If the Company fails to commence Service due to business or technical difficulties, it will notify the Service or notify the member immediately.

Article 12 (Content of the Service)

The Service provided by the company can use various additional Services provided by the Company, and the details of the additional Services are provided on the Service screen.

Article 13 (Charge and Time of Service)

  • Service is available 24 hours a day, 7 days a week. However, the Service may be suspended for business or technical reasons, or the Service may be temporarily suspended for the period set by the Company for operational purposes. In such cases, the Company will notify users in advance or after.
  • The Company may divide the service into a certain range and separately determine the available time for each range, and in this case, the contents shall be announced in advance.

Article 14 (Provision of Information and Publication of Advertisements)

  • The Company may place advertisements on Service screens, homepages, e-mails, etc. in connection with the operation of the Service.
  • The Company may provide its members with information on the Service when operating the Service

Article 15 (Deletion of Posts or Contents)

The Company may delete posts or contents of the Service that are in violation of the regulations or exceed the posting period without prior notice or consent.

Article 16 (Suspension of Service)

Company may occasionally, and any time, modify (or discontinue) this Service (or any part thereof) without notice, on a temporary or permanent basis. Member agrees that Company shall not be liable to any member or third party for any modification, suspension or discontinuation of the Service.

CHAPTER 4 RIGHTS AND OBLIGATIONS

Article 17 (Obligations of the Company)

  • The Company shall maintain the Service Providing Facilities at all times without any special reason, and shall make every effort to provide stable service.
  • The Company may provide personal information when requested by related organizations for investigation purposes under the related laws and regulations, at the request of the information communication ethics committee, or other related laws and regulations.
  • The Company shall promptly handle any complaints of members regarding the Service, and shall promptly notify the member through Service or e-mail of the reason and processing schedule if it is difficult to process the complaint immediately.

Article 18 (Membership Obligations)

  • The Member shall abide by the relevant laws and regulations, the provisions of these Terms of Use, the Notice of Use, any notification related to the Service, the notice of the Company, and shall not interfere with the business of other companies.
  • Members may not use the Service for any commercial purposes without prior consent of the Company, and may not distribute or post any material that violates the law.
  • Members are responsible for maintaining their own ID and password, and are fully responsible for all the consequences of their use. Also, if your ID and password are used without your consent, you must immediately notify the Company.
  • The member must maintain and update the contents of the application at the time it is made in a manner that is true, accurate and consistent with the current facts.
  • Members may not copy, reproduce, modify, translate, publish, broadcast or otherwise use the information obtained from the Service without the Company's prior consent or provide it to others.
  • Members cannot carry out acts that harm social order such as the placement or dissemination of pornography.
  • Members shall not engage in activities that debase the honor of others or insult or infringe on the intellectual property rights of others.
  • Members are not allowed to transmit hacking or computer viruses, or to transmit certain information such as advertising information contrary to other the will of others.
  • The Member shall not engage in anything that may interfere with the operation of the Service or that may violate the relevant laws and regulations.

Article 19 (Prohibition of Transfer)

The member shall not transfer or give the right of use of the Service or other use contract status to any other person, and all the rights and responsibilities including the copyright of posts shall belong to the member who posted it.

Article 20 (Termination and Restrictions on Use)

  • The Company may terminate the service usage contract if the member violates the Terms of Use and does not resolve it within the prescribed period of the Company.
  • The Company may restrict its approval for a period of time if a member who has been terminated pursuant to Clause 1 applies for use again.
  • When a member intends to terminate the contract, the member must apply for termination through Service or e-mail.

Article 21 (Compensation for Damages)

The company shall not have any responsibility for the damage(s), unless it is owing to its gross negligence, to its members in relation to the service(s) that the Company provides them. However, the scope of compensation will be in accordance with the provisions of the Company, separate from this agreement.

Article 22 (Disclaimer)

  • The Company shall not be held responsible for the contents of information, data, facts or credibility published by the member in the Service and shall be exempted from any liability for damages arising from the use of the Service data.
  • The Company shall be exempt from liability for member’s damages due to the data obtained through the Service, or the expected profit / loss of the member using the Service.
  • The Company shall have no obligation to intervene in a dispute arising out of the mutual service or between the member and a third party mutually and shall not be responsible for the damage caused by the dispute.
  • The Company shall be exempted from any liability in case of any disruption in the use of the Service due to the cause of the member's failure.
  • The Company is exempt from liability for the quality disabling of the supplementary services provided by the partners.
  • In the event that a member causes damage to the Company due to a violation of the provisions of this Agreement, the member who violates these Terms shall compensate the Company for all damages incurred by the Company and shall indemnify the Company from such damages.

Article 23 (Settlement of Disputes)

  • The Company and its members shall make every effort to resolve any dispute arising in connection with the Services.
  • In the event that a lawsuit is filed despite all efforts, the lawsuit shall be subject to the jurisdiction of the courts of the Company.

Addendum

Article 1 (Effective Date)

These terms will be effective January 1, 2014.

Privacy Policy Agreement

'VONSQUARE Co., Ltd.' (hereinafter referred to as 'Company') respects your personal information and abides by the Act on Promotion of Information and Communication Network Use and Information Protection.

Purpose of collection and use of personal information

Retention and use period of personal information

In principle, after the purpose of collecting and using personal information is achieved, we will destroy the information without delay. However, if it is necessary to preserve it in accordance with the provisions of relevant laws and regulations, the Company keeps the member information for a certain period as stipulated by related laws and regulations as follows.

  • Retention item: Payment history
  • Retention grounds: Records on contract or withdrawal of contracts, etc.
  • Retention period: 3 years
  • Records on contract or withdrawal of subscription: 5 years (Act on the Consumer Protection in Electronic Commerce, etc.)
  • Record of payments and supplies: 5 years (Act on the Consumer Protection in Electronic Commerce, etc.)
  • Records of consumer complaints or disputes: 3 years (Act on the Consumer Protection in Electronic Commerce, etc.)

Procedures and methods of destroying personal information

In principle, after the purpose of collecting and using personal information is achieved, the company will immediately destroy the information. The procedure and method of destruction are as follows.

  • Destruction Procedure: The information entered by the member for consultation or service application is transferred to a separate DB after the purpose has been accomplished (in the case of paper, a separate document). In accordance with the internal policy and other relevant laws and regulations, (see the period of use.) it will be destroyed after a certain period of time. Personal information transferred to a separate DB will not be used for any other purpose than that held by law.
  • Destruction method: Personal information stored in the form of an electronic file is deleted using a technical method that can not reproduce the record. Personal information printed on paper is crushed or destroyed by incineration.

Providing personal information

In principle, the Company does not provide the user's personal information to an outside party. However, exceptions are as follows

  • If users have agreed to this in advance
  • If there is a request by an investigating agency in accordance with the provisions of the Act or the procedure and method prescribed by the Act for the purpose of investigation

Consignment of collected personal information

The Company will not entrust your information to outside companies without your consent. In the event that such a need arises in the future, we will notify the customer of the entrusted person and the details of the entrusted business, and will receive prior consent, if necessary.

Or you can contact the person in charge of personal information protection in writing, by telephone or e-mail, and we will take action without delay.

If you request correction of errors in your personal information, we will not use or provide the personal information until we have completed the correction. Also, if incorrect personal information has already been provided to a third party, we will notify the third party without delay and correct the processing result.

The Company treats personal information that has been terminated or deleted at the request of the user or legal representative as described in the "Period of Retention and Use of Personal Information Collected by the Company" and this information is prohibited from being viewed or accessed for any other purpose.
